Change of Accommodation for Foreigners: When to Report It and What Happens if You Don't

Changing an address for a foreigner is not a formality. It is a legal obligation with clearly defined deadlines and penalties. Many companies and employees make critical mistakes here, leading to fines, visa extension rejections, or even administrative deportation.

Who is obligated to report a change of address?

According to Act No. 326/1999 Coll., on the Residence of Foreigners, Section 93 imposes this obligation:

  • Foreigners who stay in the Czech Republic for more than 30 days.
  • Accommodation providers (property owners, hostels, employers providing accommodation).

In practice, this means: if a foreigner moves, they must report the change themselves, even if they are aware of it and the employer or agency also informs the authorities.

By when must the change be reported?

  • Within 30 days of moving, if the change lasts longer than 30 days.

Note: If the foreigner does not meet this deadline, they risk a fine.

How to properly report a change of residence?

The change can be reported:

  1. In person at the relevant OAMP office (Department of Asylum and Migration Policy).
  2. By mail – including the completed form and attachments (rental agreement / accommodation confirmation).

Electronic submission is valid only with a recognized electronic signature.

What are the consequences of non-compliance?

If the change is not properly reported:

  • The foreigner risks a fine of up to 3,000 CZK.
  • The accommodation provider may receive a fine of up to 50,000 CZK.

Most common mistakes in practice

  • The foreigner moves, but relies on the employer to "take care of it somehow."
  • The change is reported, but without providing the contract – the authority will not register the change.
  • The foreigner is actually living elsewhere than stated – during an immigration police check, a problem arises.
